What is Stamp Duty ?
Whenever we have to get any important document or legal document made, we use stamp paper, but do you know what is stamp paper, why and where is it used?
Stamp paper is a government document on which revenue stamps of special value are printed, which are issued by the government. Stamp paper looks like a note printed on a paper which is used for various types of legal and formal work.
In which there is a stamp duty of a certain amount which is levied by the government. There are stamp papers of different values 10, 20, 50 etc. They are used for different works.
Note: There are two types of stamp papers used 1st judicial stamp paper and 2nd is non-judicial stamp paper. Judicial stamp paper is used in judicial work like court piece, legal documents etc. Whenever we have to file our case in the court, we have to buy judicial stamp papers of the value equal to the court piece required on that case and our case is prepared on those stamp papers only.
Non-Judicial Stamp Paper is used in various non-judicial works such as Agreement, Rent Agreement, Will, Power of Attorney, Affidavit, Sale Deed etc. Stamp paper is used to pay the state government fees on legal transactions.
The state government collects the fees through stamp paper. Any document is considered valid only when the fees due to the state have been paid and the payment reaches the state government through stamp paper. Every state makes laws and sets different fees for different documents.
Everyone needs stamp paper sometime in the future, although this fee varies from state to state. It is necessary to prepare the document for which the fee is fixed, on the stamp paper of the same value, otherwise the document is not considered to have legal value.
Stamp paper can be obtained from government offices or government authorized vendors. Apart from this, in some states it is also available through online medium. E-stamp paper can also be obtained which is a convenient and safe method.
The date on which you buy the stamp paper should be written on it. Whenever you buy stamp paper, keep in mind that your name, address, date, purpose of sale, why it has been purchased, all this will be written in the register of the stamp paper seller and your signature should be on it.
On the back of the stamp paper is the stamp seller’s certificate of sale on which his seal is affixed and his signature is also there. There is also the sitting place and license number of the person selling the stamp paper. If you want to verify, then you can check all this too. While buying stamp paper, you should pay the stamp paper seller an amount equal to the value of the stamp paper.
There is no need to pay extra for this. The price written on the stamp paper is its maximum retail price. But if someone is offering it to you at a price lower than this, then you should not take it because there is a possibility of it being fake.
If you have bought a stem paper and for some reason it is not of use to you, then you can use that stem paper later as well. There is no expiry date on stem paper. You can use it whenever needed. If you have bought a stem paper and have not used it, then you can return it within 6 months of purchase and apply for a refund. After deducting 10% of the stamp value, you get the remaining amount.
