Stamp Duty in Jammu and Kashmir chief minister announces zero stamp duty on property gifts to blood relatives and What is the stamp duty rate in J&K?
The Jammu and Kashmir government came up with a notification and in which they said that now you will not have to pay stamp duty on gift deed. Now what is stamp duty? It is a kind of tax. When we transfer property from one person to another, we pay a tax which we call stamp duty. How much stamp duty is to be paid?
This fixed rate is determined by the government. Every year this notification comes in which it is told by the state that in which area you are buying land for residential purpose or agricultural purpose, then how much stamp duty you have to pay on it. The same was about gift deed that if you are transferring property through gift then you had to pay stamp duty.
But now the Jammu and Kashmir government issued a notification in which they said that you will not have to pay stamp duty but this condition is limited only to blood relatives, if a person is transferring property to his blood relatives like brother, sister, parents, grandparents etc. If a property is given through a gift deed then there is exemption from stamp duty.
What documents will you have to submit on this? There should be two documents which should be the same for the receiver and the seller or the gift giver, such as Aadhar card, domicile and your other documents which were attached with this notification, you will have to submit them, only then you will get exemption from stamp duty on the gift deed.
When the budget of Jammu and Kashmir was presented, he took a big and historic decision. This decision was regarding stamp duty and for blood relations, if the property is transferred in blood relations, then the stamp duty will be waived.
This historic decision has been welcomed by the people of Jammu and Kashmir. This is a big decision and since today is the first day of the financial year, this decision has come into effect from 1 April 2025.
Let us tell you that this stamp duty which was earlier imposed on those who transferred the property, had to deposit fees ranging from 3% to 7%, which was in lakhs and crores according to the value of the property.
But the day Chief Minister Omar Abdullah said this in the budget, he said that he wants that those who want to transfer their property etc. in Jammu and Kashmir to blood relations, then this process should be easy and hassle-free and there should be no financial burden on the family.
To improve all these things, he took this historic step. Whatever it is, it has been removed and now zero stamp duty has been kept. The property which is in blood relatives will be transferred.
Now the government has issued its notification a few days ago. Santosh G. Vaidya, Principal Secretary, Finance Department had issued this notification and according to the notification, the blood relatives mentioned in it include father, mother, brother, sister, son, daughter, similarly grandfather, grandson, granddaughter, so all of them can be transferred, gifted by the transferor.
Earlier also when there was a gift etc., you had to deposit stamp duty to the government from 3% to 7%, but now it has been made zero stamp duty and now the stamp duty has been waived in the property gifted to blood relatives and now you will not have to deposit stamp duty.
At the time of transfer, you will have to show documents like Aadhar card etc. When you want to gift property etc., you have to attach these necessary documents with your application and prove that the transfer or gift you are making is happening in the blood relation, like a father gives to his son or daughter, similarly a brother-sister or sister to brother, that is, all the blood relations,
As I have already told you how it has been mentioned in this notification, so this is a very big and historic decision in Jammu and Kashmir and the people of Jammu and Kashmir have welcomed this decision because there is a tradition of gifting here.
You know that the person who wants to give a gift, tries that especially if we look at property etc., there is a trend in Jammu and Kashmir that the father gives gifts to children or brothers-sisters etc.
Because you know that Jammu and Kashmir has a very mixed culture and there is a tradition of these things here and when stamp duty etc. is imposed on these things, then many gifts, property transfers through gifts used to stop because when stamp duty was imposed… the stamp duty was calculated when the stamp duty fee of 3% to 7% had to be deposited, then people used to stop there and the transfers etc. did not mature.
But now to make this process simple and easy and to improve it so that the burden of stamp duty does not fall on the families, this announcement was made by the Chief Minister and now this decision is being implemented in Jammu and Kashmir from today.

So let me quickly tell you what was special for Jammu and Kashmir in the last budget. First of all, you have heard that women of Jammu and Kashmir will get free travel in e-buses and government buses.
What are some of the main points? AAY families, that is, poor families will be given 10 kg ration and 200 units of electricity for free. Along with this, three supermarkets will be opened in Kupara, Poonch and Bandipora.
The pension given to the poor will be increased. Marriage Assistance Scheme, that is, the government helps in the marriage of poor girls, now if we transfer property in blood relations, you will have to pay zero stamp duty.
